General Conditions of Sale

These conditions are agreed upon between the company BE2ADORN – DECORAÇÃO, LDA., headquartered at Rua Neves de Sousa, nº 26, 4º esq, 2780-272 Oeiras, with share capital of € 5,000, enrolled with the Commercial Registry Office (CRC) of Lisbon under  unique taxpayer number 514989181, hereinafter referred to as “BE2ADORN”, and any other  individual entity wishing to effect a purchase on the BE2ADORN brand website be2adorn.com, telephone number +351 96 866 88 96, hereinafter referred to as the  “User/Consumer”.

1.1 – The “Seller”, BE2ADORN – DECORAÇÃO, LDA, has products for sale on the website be2adorn.com, whereby the e-commerce services are available exclusively to end users / “consumers”.

1.2 – The “Consumer” indicates the individual that acts/purchases outside his/her business or profession. If you are not a “consumer” we ask you not to purchase on the online shopping sales website be2adorn.com.

1.3 – BE2ADORN reserves the right not to process orders received from users who are not “Consumers” and those who are not in agreement with the general conditions of sale of the Seller BE2ADORN.

1.4 – These general conditions and terms of sale exclusively regulate the offer, transfer and acceptance of the orders submitted on be2adorn.com between consumers of the online BE2ADORN store (be2adorn.com) and the Seller.

1.5 – The Consumer should provide the Seller with an e-mail address or accurate and complete data for another form of contact, and accept that the Seller may contact him/her using this data, when deemed necessary.

2.1 – To place an order on be2adorn.com the User/Consumer is required to possess an e-mail account and a browser configured to accept cookies and pop-ups as a means of ensuring users are able to enjoy full use of the browsing conditions of the online BE2ADORN store.

Placing an order on be2adorn.com is simple:

  1. Find the products you wish to acquire;
  2. Add the products you have selected to your shopping basket;
  3. Conclude the purchase;
  4. Select the payment option;
  5. Check your order;
  6. Proceed with payment and confirm the order;
  7. You will receive confirmation of the order via e-mail;

Your order is conformed when you click on the “Confirm Order” tab at the end of the shopping process.

When BE2ADORN receives tour order a message will appear on the screen with your order number and all the details of the same. The purchase agreement is completed at this time.

You will receive confirmation of the order via e-mail. We suggest you print out or download a copy of this confirmation for future reference.

We reserve the right not to accept your order or to cancel it even once it has been automatically confirmed.

On sending the order form you are accepting the general terms of purchase, in addition to other existing conditions implemented at be2adorn.com, through links, including the general conditions and terms of use.

The Seller may not process orders without a sufficient guarantee of collection, when an order is incomplete or incorrect, or when the product ordered is unavailable. In these cases, we will notify you by e-mail that the agreement of sale has not been executed and that the Seller has not gone ahead with the sale, specifying the reasons for such.

If the products advertised on the online store (be2adorn.com) are not available at the time of your most recent visit or when the Seller receives the order, the Seller should notify you that the products are unavailable within 30 days of receiving the order.

In the event an order has been placed and paid for products that are not available, the Seller will reimburse the amount paid for the unavailable items.

2.2 – The right not to accept the order and cancel the purchase

BE2ADORN reserves the right not to accept any order for any reason. We also reserve the right to cancel any order (even if we have already accepted it), (among others) in the following situations, and will not be held liable for any loss or damages:

* The product is not available / in stock (payment will be reimbursed);

* The billing data is not correct or verifiable;

* The order is marked by our Security Systems as an incorrect order or a potentially fraudulent order;

* We have not received payment for the order within a period of 5 days of the date on which the order was accepted

* If we suspect you are under 16 years of age;

* If we suspect you are a retailer;

* It is impossible to deliver the order to the address provided.

2.3 – Verification of data

After receiving the order we may conduct certain checks before preparing it.

These checks may include the verification of your address, credibility and a fraud check. With regard to fraud we conduct partially automated checks of all orders as a means of screening against unusual, suspicious and potentially fraudulent transactions. Suspected fraud will be investigated and. where necessary, prosecuted. Confirming your order means you have agreed to these conditions.

3.1 – Forms of payment

The forms of payment available are specified in the Methods of Payment section on the website. We do not accept any forms of payment other than those already mentioned. Please do not attempt to pay using any means other than those specified. If you do, we will not be held liable for any loss or other damages arising from the transaction.

3.2 – Processing of payment

If you effect payment with a credit card we will debit the amount owed from your account as soon as the order leaves our warehouse. In the case of payment with a credit card, all the details (card number and expiry date, for example) will be sent via an encrypted protocol to the remote electronic payment services provider, whereby no third party will be able to access the information transferred. This information will not be used by BE2ADORN except to conduct the necessary procedures in relation to the purchase or reimbursement, in the event of returned goods, in accordance with the exercise of the right to reimbursement or to report cases of fraud to the police. The price of the purchase of the products and transportation costs, as specified on the order form, will be charged to your current account when the items purchased are actually dispatched.

4.1 – The store be2adorn.com uses first-rate security technology between the encryption platforms available.

Your payment data will be encrypted from the time it arrives until after the transaction has been processed and will not be stored on a public server. Despite the fact we use encrypted software, the security of information and payments transferred via the Internet or e-mail cannot be guaranteed. BE2ADORN will not be held liable for any loss suffered as the result of the use of electronic means of communication, including, but not limited to, loss arising from faults or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or computer programs used for communications or the transfer of viruses.

If you choose to pay through the Multibanco system, we will begin to process the order once the payment has been received. This may take a few days. Orders for which no payment has been received within 5 calendar days of placing the order will be cancelled. Payments will only be processed if the information to be used for billing can be verified.

BE2ADORN holds the ownership of the company´s products until we have received full payment for all these products.

6.1 – The prices of the products on offer on the website include Value Added Tax (VAT). Deliver costs will be added per order. The exact price of the delivery will depend on the country in which the order is to be delivered and will be displayed on the product page in accordance with the country the system detects. You may select another country on the checkout page (which appears after clicking on “Conclude Purchase”). The price indicated on the product page refers to 1 single unit of this product. The total cost of delivery for orders consisting of multiple units will be displayed on the checkout page.

6.2 – All prices are expressed in euros with the exception of the United Kingdom (pounds sterling). Please not that the country of delivery may have an influence on the prices due to transport costs.

6.3 – The total price

The total price specified at the end of the checkout menu includes taxes and delivery costs. Prices are quoted at the time of confirmation of the order, and may be printed out or downloaded for future use. Please only pay the exact amount specified in the order confirmation and effect individual payments per order.

6.4 – Changes in price

The product prices specified on the website are subject to change. BE2ADORN reserves the right to change prices with no prior warning. The prices displayed at the time of the purchase are applicable to that purchase.

6.5 – Errors in prices

Please note that even though the website is kept up to date with extreme care, information on the website in relation to prices may contain errors. BE2ADORN is not committed to the offer and reserves the right to cancel your order in the event of such an error.

The main characteristics of each product are featured on each product page on be2adorn.com.

The products sold by BE2ADORN are artisanal and, as such, production by human hand gives rise to minor variations in texture and colour. We believe these variations afford our products character and exclusivity and should be appreciated by Users/Consumers. When something is truly handmade, we should appreciate not only the object, but also the evidence of the craftsman´s skill.

These features will not be regarded as defects or damage. However, the provisions of this clause will not affect the rights of Users/Consumers or their right to cancel the agreement.

The candles on sale on be2adorn.com may differ slightly with regard to the real candles in terms of image and colours, also due to the Internet and browser and monitor used.

All the candles have an identification label on the base. Do not remove the label from the product purchased if you intend to return it.

In the event you decide to exercise your right to return the products purchased, BE2ADORN will have the right to refuse products returned without the label or whose original state has been altered or damaged.

8. Delivery2019-03-25T17:17:48+00:00

8.1 – Delivery: where and when

We deliver our products between 9 a.m. and 6 p.m. from Mondays to Fridays. We do not deliver on public holidays. We can only meet our delivery obligation if the delivery address is a house or office located in one of the countries listed on the Deliveries page.

Someone will be required to be at the address to receive the order. This service does not include the option to schedule a time and the order will be delivered without the carrier contacting the client beforehand. In the event the contact person is not present at the time of the delivery, we will leave a message or contact you to arrange another attempt. We will not guarantee our delivery deadlines at times of promotions, sales, Christmas and stock clearance.

A delivery is regarded as having been executed or a product as having been delivered once the delivery note has been signed at the agreed upon address.

 

8.2 – Delivery timeframes

If your order is confirmed by midday on a working day and payment is effected with a credit card or via Paypal, your order will be dispatched within two working days (weekends and public holidays are not regarded as working days) and the delivery timeframes are those specified on the product page after selecting the country of destination. In the event you choose to pay using the Multibanco system, the delivery process is less efficient due to the fact the order will only be dispatched once the payment has been received. This may take from between 5 and 7 days.

The “Seller” will not be held responsible for non-compliance or delays in compliance with any obligation arising from an event of force majeure, that is, a happening, act or omission beyond their reasonable control (Event of Force Majeure – consisting of any happening, act or omission beyond the reasonable control of the “Seller”).

We will attempt to deliver by the specified deadline to the extent this is commercially reasonable. As a general rule we proceed in this manner, however we are unable to guarantee deliveries are made on time.

8.3 – Partial deliveries

We will already strive to make a single delivery whenever possible. However, we reserve the right to split a delivery if part of an order has been delayed or is unavailable, for example (but not limited to). In the event we split an order the User/ Consumer will be notified of our intent to proceed in this manner by e-mail. The e-mail address supplied by the User/Consumer at the time of the purchase will be used for this purpose.

9.1 – Deliver costs will be added per order The exact cost will depend on the country to which the order is to be delivered and the weight of the package. Select the country of delivery on the checkout page for more information on delivery fees by country.

9.2 – Free delivery

If the User/Consumer places an order with a minimum order value above that specified for their country or campaign, the order will be delivered at no cost, or in other words, free of charge.

10. Returns and Cancellations2019-05-14T11:20:21+00:00

10.1. – Cancellation of an order prior to dispatch

Users/Consumers may cancel an order provided it has not already been dispatched. If the User/Consumer places an order and intends to cancel it, he/she should first check the status on the My Order menu located in the top right corner of the website´s homepage. If the order status states “Registered” it may still be cancelled. However, the User/Consumer should contact our Consumer Support Department and ask to cancel the order. Our Consumer Support Department can only ask the warehouse to cancel the order once this procedure has been concluded. If the request for cancellation is successful, the User/Consumer will be notified of the decision by e-mail and the cancellation will be processed at no cost to the User/Consumer. In the event cancellation is not possible the products will be sent to the User/Consumer who, if he/she still wishes to cancel the order, should refuse to take charge of the delivery. The products will be returned and the reimbursement processed.

10.2 – Return of defective products

Users/ Consumers have the right to return any product ordered and delivered with a defect or any other non-conformity. An order may be returned within 30 days of the date on which it is delivered. This will not affect the User´s statutory rights. If the complaint is justified, the price and costs of the order will be reimbursed. Please access the Return of Products Policy menu in order to obtain further information on how to return products and on reimbursement.

10.3 – Returned products and right of withdrawal

If for any reason you are not satisfied with the products you have ordered you may return them within a period of 30 calendar days of the date on which they were delivered, provided:

  • The product has not been used;
  • The product still has its original features and the packaging is not damaged (packaging that has been opened carefully will not be regarded as damaged);
  • The product is complete (for example, both items of a pair have to be returned);

You may not return:

  • Products that have been adulterated.

10.4 – Return of special offers

A person receiving a product as a special offer from another person may not return it pursuant to our current rules. In this case, you should contact the person who bought it, who may proceed to return it in accordance with the Return of Products Policy.

10.5 – Information on returns

In the event the product ordered is ascertained to have been delivered with a defect or non-conformity, BE2ADORN will bear the cost of delivering and returning the product. In the event you returned the product for reasons other than the justified existence of a defect or non-conformity, BE2ADORN will reimburse you, including the delivery cost from our warehouses to the User/Consumer, but will only be able to ensure the transportation costs related to the return in some specific cases. You can consult the specifics mentioned in the menu “Return Policy.

Reimbursement will be effected based on the form of payment. Users/Consumers effecting payment using the Multibanco system will need to provide our User/Consumer Support Department with their banking details when beginning the return process. We need this information to enable us to reimburse the money to your account. The User/Consumer will receive the reimbursement once the product(s) has been returned and processed.

Consult the “Return of Products Policy menu for further information on the procedure for returning goods. Please read and follow the instructions in this section carefully in order to prevent any unnecessary delays.

12.1 – When used in accordance with the established rules, a promotion code enables a user to enjoy a promotion/discount in relation to the purchase of a specific product or for a set of products, in the period in question/associated with the promotion code/ promotion campaign.

12.2 – The sale, exchange or donation of a promotional code is not permitted.

12.3 – The promotion code is associated with the BE2ADORN brand. The use of a promotion code in connection with any other company, brand or name is not permitted. Furthermore, the illegal, abusive or disrespectful use of promotion codes is prohibited, as well as in any other manner that might undermine the reputation of BE2ADORN.

12.4 – The use of promotion codes is subject to just one use per product and per order. Promotion codes are not cumulative with any other promotions or special offers.

12.5 – Promotion codes are not exchangeable for money.

12.6 – Without prejudice to any other rights BE2ADORN may have, we have the right to invalidate a promotion code immediately in the event BE2ADORN has reason to suspect that a promotion code is being used: in breach of the aforementioned conditions, by usurpation or in other cases in which BE2ADORN has reasons to proceed in this manner.

All orders placed on the site are subject to availability. BE2ADORN strives to guarantee all the items placed on sale are in stock. However, BE2ADORN reserves the right to refuse an order or to cancel an order that has been confirmed for products that are not in stock. In these cases BE2ADORN will notify the User/Consumer of the fact and proceed to reimburse the amount paid.

Offers are only valid for the time they are displayed on the website, unless information on the website states otherwise. BE2ADORN is not associated with any offer, in the event spelling mistakes or errors in prices or other information existing on the website are registered. 15.1 – BE2ADORN will only be held liable for loss suffered by the User/Consumer in the event such loss arises from violations attributable to the contractual obligations of BEADORN to the User/Consumer, or in the event the liability of BE2ADORN arises from applicable legal rights.

15.2 – In the event the User/Consumer has suffered loss in relation to the activity of the website, the liability of BE2ADORN will be limited to:

  • Damage to BE2ADORN products or other materials;
  • Reasonable and verifiable costs incurred by the User/Consumer to discover the cause and amount of indemnity attributable to the loss;
  • The maximum reimbursement of the aforementioned indemnity will be (where applicable) the price of the products in question.

15.3 – BE2ADORN will not be held liable for any loss suffered by third parties arising from the use of any of our products. BE2ADORN will not be held liable for any loss suffered by the User/Consumer as the result of the improper use of our products.

15.4 – BE2ADORN will not be held liable for any loss arising from incorrect information on the website.

15.5 – In the event the User/Consumer suffers loss as the result of gross negligence or willful misconduct by BE2ADORN, none of the limitations set forth in this article will apply.

These general conditions and all disputes arising from the same, including their validity, the use of the website or any purchase made on the website will be governed by Portuguese law.
